Employer - Responding to a Personal Grievance

A Personal Grievance or ‘PG’ is a formal complaint made by an employee against their current or former employer.  Raising a Personal Grievance, whether verbally or in writing, is the first step in an employee making a legal claim against their employer with the Employment Relations Authority (ERA).  Generally, it must be raised within 90 days of the issue occurring.

What to be aware of when a Personal Grievance claim is made

Raising a Personal Grievance is the first step in an employee making a legal claim against their employer with the Employment Relations Authority (ERA), although it doesn't always end up going that far.  Generally, it needs to be raised within 90 days of the issue occurring and is put in writing.  Both the employer and the employee are entitled to have a representative during the process.  The employer should aim to respond to the claim as soon as possible and this must be within two weeks / 10 working days.  If you have any uncertainty about how to respond you should seek professional advice immediately.  Don't delay, the longer it takes for you to respond the more likely you are to upset the employee and make them feel they aren't being taken seriously.

Personal grievance claims can include but are not limited to:

  • bullying at work

  • sexual harassment

  • racial harassment 

  • discrimination

  • unjustifiable action that disadvantages the employee

  • unjustifiable dismissal

  • duress due to union membership
