Recovering Unpaid Wages

What are my rights when it comes to pay?
In New Zealand, you have the right to:
be paid at least the minimum wage (currently $18.90 per hour)
be paid at the rate agreed on in your employment contract
access records of time worked and money earned for the past six years, even if no longer employed
be paid agreed overtime rates
receive holiday pay
How do I know if I'm owed money?
If one of the following situations have occurred, you are owed money:
You were not paid for every hour that you worked
You were paid under the minimum wage within the last six years
You were paid for less than agreed in your employment contract
You did not receive your overtime rates
You did not receive your full holiday pay
Your pay has been reduced for an unfair reason
What do I do next?
The first step is to contact your current (or past) employer about your concerns. Make sure you do this in writing and keep a record of it. You should ask for all relevant timesheets and payslips for the period in question. This will enable you to show how you’ve been underpaid so you can request to be paid what you're owed. If there are difficulties in recouping the money, legal action can be taken.
