Constructive dismissal occurs when an employer places an employee in a situation where they have no option but to resign. If this has happened, you may be entitled to compensation. 

What can be classed as Constructive Dismissal?

There are 3 main categories:

  • your employer has given you an ultimatum; if you don't resign you will be fired

  • your employer has deliberately conducted themselves in a way that has pressured you to resign

  • you feel you have to resign due to your employer's breach of duty e.g. not paying wages, not providing safety gear, or another significant breach of employment terms.
